These Terms of Service and Privacy Policy ("Agreement") govern the access to and use of the IPPM Now mobile application and related services (the "App"), operated by Insect Track Solutions Inc., a corporation incorporated under the laws of Saskatchewan, Canada, with its registered office at 15 Innovation Blvd #230, Saskatoon, SK S7N 2X ("Company", "we", "us", or "our").

By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must immediately discontinue use of the App.

1. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use the App.

2. Nature of the App – Decision Support Only

IPPM Now is a decision-support tool that provides informational, analytical, and experimental outputs related to:

  • Insect identification
  • Ecological and agricultural observations
  • Integrated pest and pollinator management insights

The App does not provide professional advice and does not issue management prescriptions or regulatory guidance. All decisions made based on App outputs remain solely the responsibility of the user.

3. Beta / Pre-Release Disclaimer

The App is provided as a beta, alpha, pilot, or minimum viable product (MVP) version.

You expressly acknowledge that:

  • The App may contain errors, bugs, or inaccuracies
  • Features may change, degrade, or be removed at any time
  • Data and outputs may be incomplete or incorrect

The App is provided "AS IS" and "AS AVAILABLE", without guarantees of stability or performance.

4. Artificial Intelligence Disclaimer

The App uses artificial intelligence and machine-learning models.

You acknowledge that:

  • AI-based identification is probabilistic, not deterministic
  • Outputs may be inaccurate or incomplete
  • Model performance depends on image quality, context, and environmental conditions
  • Results should not be relied upon as definitive or authoritative

The Company makes no guarantee of accuracy or completeness of AI outputs.

5. Agronomic & Scientific Disclaimer

The App does not replace professional agronomic, entomological, ecological, or extension advice.

We do not guarantee:

  • Detection completeness
  • Economic outcomes
  • Management effectiveness

Insect populations are dynamic and influenced by factors beyond the App's control.

6. Data Collection

6.1 Data You Provide

  • Email address or account credentials (if applicable)
  • User-uploaded images (e.g., insects, field conditions)
  • Optional contextual information, including:
    • Crop type
    • Pesticide use (yes/no)
    • Comments or observations
  • Communications and feedback

6.2 Automatically Collected Data

  • Device and app information
  • Log and crash data
  • Usage analytics
  • Approximate location (if enabled)

7. Use of Data & AI Processing

Collected data is used for:

  • Providing App functionality
  • Training, testing, and improving AI models
  • Research and development
  • Debugging and performance monitoring
  • Aggregated ecological and monitoring analyses
  • Legal and regulatory compliance

8. Data Storage & Security

Data is stored on secure servers using reasonable administrative, technical, and organizational safeguards.

However, no system is completely secure, and absolute security cannot be guaranteed.

9. Data Sharing

We do not sell or rent personal data.

Data may be disclosed only:

  • To trusted service providers under confidentiality obligations
  • Where required by law
  • In connection with corporate transactions (e.g., merger, acquisition)

10. Data Ownership

10.1 User Content

Users retain ownership of uploaded images and content.

By submitting content, users grant the Company a non-exclusive, royalty-free, worldwide license to:

  • Store and analyze data
  • Train AI models
  • Generate aggregated and anonymized insights

10.2 Derived Data

The Company retains ownership of:

  • Aggregated datasets
  • Anonymized data
  • Model outputs
  • Statistical analyses and predictions

11. Intellectual Property

All intellectual property related to the App, including:

  • Software
  • AI models
  • Algorithms
  • Databases
  • Designs and logic

is owned by Insect Track Solutions Inc.

Users may not copy, reverse engineer, or use the App to develop competing products.

12. User Responsibilities

You agree to:

  • Use the App lawfully and responsibly
  • Not rely on the App as the sole basis for decisions
  • Not misuse or interfere with the system

13. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for:

  • Crop losses
  • Economic losses
  • Management decisions
  • Indirect or consequential damages

Total liability shall not exceed CAD $100 or the amount paid by the user (if any).

14. Termination

We may suspend or terminate access at any time if:

  • This Agreement is violated
  • The App is misused
  • Legal or security risks arise
